  • On 3 May 2019 the Seller completed the purchase out of title number ST17630 (a copy of which is with the auction legal papers) of a piece of land adjacent to its development at Donyatt and adjacent to Crow Lane from Somerset County Council ('the sec Land'). A copy of the Transfer is with the auction legal papers. That transfer has been registered at HM Land Registry under title number WS87960. The purpose of the acquisition was to accommodate the actual footprint of the development and to remove any possible doubt as to the contiguity of the development with the adopted highway at Crow Lane. Therefore 1 The Meadows Crow Lane, Donyatt, nr llminster, Somerset, TA19 0RG is comprised partly within Title Number WS72280 and partly within Title Number WS87960.
  • The land in Title Number ST17630 is subject to a right of way in favour of Country View (registered at the Land Registry with Title Number ST64575) created by a transfer dated 29 September 1989 made between (1) Somerset County Council and (2) Stanley Ernest Bealey and Margaret Eva Bealey as referred to at entry C34 of ST17630 and a copy of which is with the auction legal papers ('the 1989 Transfer'). Entry C34 of Title Number ST17630 has not been reproduced within the register of title to Title Number WS87960. However the seller believes that the present owner of Country View (registered at the Land Registry with Title Number ST64575) may assert (1) that the northern end of the house constructed on 1 The Meadows Crow Lane, Donyatt, nr llminster, Somerset, TA19 0RG has been built upon part of the said right of way and (2) a claimed right to park on part of the area affected by the right of way (see the email from the present owner to Linda Hayden dated 25 July 2016 timed at 12:42) in the context of an objection to the planning permission for the development . The Seller is of the view that the said right of way granted by the 1989 Transfer does not itself permit parking and that nothing has been produced to the Seller that meaningfully supports any right of parking.
  • On 6 September 2019 the Seller completed the sale of 2 The Meadows Crow Lane, Donyatt, nr llminster, Somerset, TA19 0RG ('the Plot 2 Transfer'). A copy of the Plot 2 Transfer is with the auction legal papers. 1 The Meadows Crow Lane, Donyatt, nr llminster, Somerset, TA19 0RG is sold subject to and with the benefit of the provisions of the Plot 2 Transfer. The Plot 2 Transfer is in the course of being registered at HM Land Registry and has provisional title number WS88779 allotted to it.
